Prejudice in “Of Mice and Men” Essay

â€Å"Prejudices are the chains forged by ignorance to keep men apart.† – Marguerite Gardiner. In society, both modern and in the past, prejudice has been a tool of thinking and labeling a group of race, people, class and culture in order to distinguish ones superiority and dominance from one another, but is simply a way to judge without gathering valid facts. In Of Mice and Men by John Steinbeck, we see that prejudice was just as rampant in the 1930’s. In the novel, prejudice is demonstrated on 3 different levels: racial, sexual and social. It is shown how these prejudices generate false perceptions that although meant to aid, do no such good as their end result is clouding the truth. Racial prejudice is most significant when describing Crooks, who happens to be the stable buck for the farm. Crooks is also a Black man with a back disability, hence the reason he is called â€Å"Crooks†. While most of the other workers live in the same area and attend to jobs that are quite similar, Crooks is forced to live by himself, work alone in the stables and is almost never in contact with any of the other characters. People such as Curly’s Wife go as far as to ridicule Crooks and even look down at him simply for the fact that he is a Black man with a disability who is a laborer. In one instance, Curly’s Wife threatens Crooks by telling him â€Å"Listen, Nigger, you know what I can do if you open your trap, I could get you strung up on a tree so easy it ain’t funny† (Steinbeck, 98). The open brutality of this comment shows that even a woman, who would normally not have much or any say during this time in the 1930’s, is still considered higher in social class than an African-American man. Nothing is known about him as a person by any of the other farm attendants, but the prejudices that in this case are completely false help propel a gap between them, when one does not need to be. Although he may be physically handicap, he is just as capable as any of the others. As a result of being an outcast at the farm, Crooks has become very isolated and disengaged with the other members. When Lennie enters Crooks cabin in order retrieve the puppies, Crooks lashes out and tells Lennie â€Å"I ain’t wanted in the bunk room and you ain’t wanted in my room† (Steinbeck,124). This comment shows that Crooks has become bitter and alone because of the prejudice constantly being aimed at him when there is no reason for the way he is treated. He is a great overall example of racial  prejudice in Of Mice and Men and society, both past and present, in which a African-American male, who is as capable as any man of another color is denied the same opportunities because of stereotypes and perceptions which can only be supported with biased false facts. Sexual prejudice is strong when Curly’s Wife is a part of a scene. Curly’s Wife also happens to be the only female that is currently occupying the place of work that the novel is set in. Curly’s Wife is presented as a character who tends to be very friendly with all the men on the farm and enjoys the attention she gets because her husband, Curly does not give her the amount of attention that she wants, so she finds it with others. Curly’s Wife is often avoided by all other who work at the farm because she is a woman who could get them in a lot of trouble. Curly is the boss’ son and Curly’s Wife being the daughter-in-law always gets her way and can have any man in the farm fired without reason. â€Å"She got the eye goin’ all the time on everybody. I bet she even gives the stable buck they eye. I don’t know what the hell she wants† (Steinbeck,51). Being a woman, there is already significant amount of sexual prejudice directed to her and the fact that she is very flirtatious with the other men further strengthens their perception of her. They all try to remain as calm as possible, careful not to give her the wrong idea cause they know the trouble that she could get them in. In actuality it appears that Curly’s Wife only craves attention from the other men and nothing sexual because of the lack of her husband to give her the attention that she wants. The idea of her wanting something only sexual and not spiritual shows the prejudice associated with gender in this novel and how its falsehood prevents a lonely woman from engaging and connecting with others on a mental level. Equally important is the Social prejudice towards characters such as Candy and Lennie in Of Mice and Men. Candy is very old and not capable of doing much around the farm but is still kept around to do the simple chores that the others are seen as more of a waste of time for others. These simple chores are envied by others and this jealousy helps create a division between Candy and the others. Candy also has a dog that in many ways is similar to him â€Å"[The] dog ain’t no good to himself. I wisht somebody’d shoot  me if I got old an’ a cripple (pg. 45).† They are both described as being old, withered, confused and in many ways more of a nuisance who would do more good dead than alive. Socially being hated by the majority of the men at the ranch shows the prejudice that is directed without any reason, but simply motivated by jealousy. In the instance of Lennie, social prejudice is strongest evident in the perception others have of him because in their eyes, all they see is a big oaf incapable of accomplishing anything intelligent and only kept around for his strength. Before meeting Lennie and even engaging him in conversation, his position has already been established at the Ranch. With Curly we see that â€Å"[He’s] like a lot of little guys. He hates big guys. He’s alla time picking scraps with big guys. Kind of like he’s mad at ’em because he ain’t a big guy† (pg. 26). Regardless of his ability to be of help at the farm, Curly already establishes his position on Lennie even though he has had no significant direct contact or enough time to accurately depict Lennie as a person and not just a big man physically. Not only Curly, but other members of the farm also have decided Lennie’s place at work before fully knowing him. He is left out of card games, left back at the ranch when George and the others go out to hand more important jobs. Being considered a simple minded men with little use who spend their days playing with and day dreaming about rabbits or sweeping after others, Lennie and Candy have become outcasts in the sense that one of them is perceived to be mentally unstable and added to the fact that he is physically strong, while the other one is a nuisance who many could live without, make them both isolated and all the more reason to be avoid and singled out. â€Å"Of Mice and Men† is a brilliant novel in demonstrating that prejudice is a tool that people use to become more familiar with other individuals in order to overcome the fear of uncertainty. However, the ending result is that it puts distance between the person and the one they judge because it is not fact, but perception that is completely untrue. Prejudice is simply the reasoning of a fool to make themselves feel secure.

How did Shakespeare appeal to his audience, both in the 17th century, and in the modern era? Essay

Shakespeare’s play, Macbeth, created a big impact when it was written and first performed and it is still popular and well known. So why do so many people still enjoy it? What did Shakespeare do to capture his audience so well? Act 1, Scene 3 is the scene in which the witches meet again. One tells a detailed story about a sailor whom she is planning to torture. This shows the audience how mean the witches can be so the audience isn’t true how trustworthy they are. Soon after, the witches meet with Banquo and Macbeth and they tell them both prophecies; calling Macbeth Thane of Glamis (which he already is), Thane of Cawdor, and they say that he â€Å"shalt be king hereafter† (line 58). At the end of the scene, Ross and Angus come to inform Macbeth that he is thane of Cawdor. It is once they’ve left that he realises that one of the witch’s prophecies has come true so he starts to wonder about the second one. Act 5 is the last act of the play and in scene 5; there are two main events. Firstly, he is told by Seyton, a messenger, that his wife is dead. After this, Macbeth has a soliloquy. Then, straight away, a messenger hurries in and tells Macbeth that Birnam Woods are advancing. This is a turning point in the play because at this point, Macbeth recalls the witches’ prophecy, which said that he was not die until Birnam Woods advanced. The scene ends with Macbeth ordering to ring alarms. The main characters in Act 1, Scene 3 are the witches, Macbeth and Banquo. The witches seem like a big contradiction. The first witch told a story about torturing a sailor to death because his wife refused to give her chestnuts! This shows just how evil the witches were. However, they called themselves sisters and they worked together. For example, the second and third witches offer to give the first witch wind to help. â€Å"I’ll give thee a wind† (line 10). This is contradictory because they have a good side and a bad side so it makes the audience ask themselves if the witches can be trusted. It turns out, at the end of the play, that although the witches told the truth, a lot of trouble could have been avoided if they hadn’t intervened because Macbeth would not have had the ambition to be the king. This is the first scene in which we see Macbeth on stage. So far, he has been portrayed as a brave soldier and â€Å"noble Macbeth†. However, when he sees the witches, he becomes scared. We know Macbeth doesn’t want to admit that he is scared because he doesn’t say it. However, we can tell because in line 49, Banquo says, â€Å"why do you start and seem to fear / things that do sound so fair?† Banquo doesn’t believe the witches at first. He doesn’t take them seriously at all and once they have vanished, he asks himself if him and Macbeth had taken drugs: â€Å"or have we eaten on the insane root,† (line 82). When he finds out that Macbeth is actually Thane of Cawdor, he is really surprised and in line 105, says, â€Å"what, can the devil speak true?† The â€Å"what,† shows the audience that Banquo is surprised. Macbeth is the only major character in act 5, scene 5. However, he changes a lot throughout the scene. At the beginning, he is extremely confident. He says, in lines 2 to 3 that his â€Å"castle’s strength / will laugh a siege to scorn†. After he hears the cry from offstage, he talks to make the audience feel sorry for him. â€Å"I have supped full with horrors,† (line 13) means that he has had enough horror so he is immune to them. He seems numb to the Queen’s death. This is really odd because at the beginning of the play, he seems truly in love with his wife. He only mentions three lines about his wife. After this, he starts talking about life. When the messenger tells him the news about Birnam Woods, he becomes really rude and calls him a â€Å"liar and slave!† Very soon after, he appears much less confident than at the beginning of the scene. He even tells the messenger that he can treat him like he would treat the messenger, which is to hang hi m on a tree until he dies of hunger. Line 39, â€Å"if thy speech be sooth / I care not if thou dost for me as much† The witches in Act 1, Scene 3 all speak in verse; the rhythm is steady and they speak in rhyming couplets. This shows that they are different and odd to normal people. They also speak to Macbeth and Banquo in riddle. This gives the audience doubts about how trustworthy the witches are. In fact, this turns out to be the main problem in the play because a lot would have been avoided if Macbeth had known the whole and exact truth. As soon as Macbeth arrives, he asks lots of questions. He seems desperate to know more and in his speech in line 68, he pleads the witches to â€Å"tell him more†. He also says everything that is going through his head out loud. This shows the audience that he is confused. In this speech, he also uses a lot of commanding words such as â€Å"say†¦ I charge you†¦ you owe†¦ speak†¦ tell†. After the witches vanish, Macbeth starts speaking in really short sentences, which make him seem more thoughtful because we don’t know w hat he’s thinking in between his sentences. After Ross and Angus have left, Macbeth says a lot to the audience (soliloquies). This shows his thoughts and gives the audience audience privilege. This makes the plot seem more exciting. He asks himself a lot of questions in these speeches, which is a change from the constant commanding tone he was using earlier. Lines 131-135, he says, â€Å"why hath it given me earnest of success† meaning, ‘why was I promised a promotion (to be the Thane of Cawdor)’ then he goes on to ask himself â€Å"why do I yield to that suggestion†¦Ã¢â‚¬  meaning, ‘why does it give me such horrible thoughts?’ The audience do not know what these thoughts are although later, we find out that he couldn’t help thinking of murdering King Duncan. At one point, Macbeth even goes into a daze! We know this because in line 142, Banquo says, â€Å"look how our partners rapt.† At the beginning of Act 5, Scene 5, Macbeth gives a lot of orders (Shakespeare used lots of exclamation marks when writing the play). These show that Macbeth is very confident. In lines 2-4, Macbeth says, â€Å"Our castle’s strength will laugh a siege to scorn†. This shows he is not just confident in his way of saying things, but also very arrogant and confident that he will win. However, after his wife, the Queen, dies, Macbeth’s confidence drops. His soliloquy makes the play less realistic because people don’t usually talk to themselves however it is still evocative because it clearly shows Macbeth’s emotions. In his soliloquy, Macbeth mentions that his wife should have died at a more convenient time; line 17, â€Å"she should have died hereafter.† This shows that Macbeth is suddenly completely numb in contrast to him being deeply in love before his wife died. Perhaps, at this pint he is telling himself that he didn’t really care abo ut the Queen because he didn’t want to show his being upset. In line 20, Macbeth starts talking about the meaning of life. This is showing he has a soft side and it’s also the point at which, in my opinion, he really starts to feel sorry for himself and realises the damage of all his mistakes. This section could also be a metaphor because he is comparing life to a play. He reminds the audience that the play is just an unreal story by saying that it’s just a story â€Å"told by an idiot†. It may be that Shakespeare is calling himself an idiot but I think this is highly unlikely. I think, on the other hand, that Macbeth is calling the author (Shakespeare) an idiot because Macbeth’s part in the play is not nice (he turns out to be the tragic hero). Moreover, by saying that an actor plays his character â€Å"and then is heard no more†, Macbeth hints at the end of the story at which he dies. Also, he is near the end of his acting and will probably be seen no more. He is emphasizing this point; perhaps to let people remember him once the play is over. It seems as though Shakespeare wrote this as Macbeth’s true moments, by himself, on stage as the hero. Macbeth’s evocative soliloquy, which shows his soft side, contrasts his really rude manner later. For example, in line 34, he shouts â€Å"liar and slave†. Then he quickly becomes less scary as he starts doubting himself and he even tells the messenger that he has the permission to hand Macbeth onto â€Å"a tree till he dies of hunger†. These sudden changes in moods and politeness show that Macbeth has confused emotions. Equivocation and Evil are the two main themes in Act 1, Scene 3. Equivocation is also the main theme throughout the play. In scene 3, the witches all talk in riddle. This is unclear and therefore a form of equivocation because if the witches told the complete truth, the plot would have been completely different. For example Macbeth would have understood the Birnam Woods riddle. He would have understood that the ‘forest advancing’ meant an army of soldiers against him. Evil is the other main theme in Act 1, Scene 3. This is the scene in which Macbeth contemplates killing King Duncan. He describes his thoughts as awful and they can’t even be spoken; lines 138-139 â€Å"Whose horrid image doth unfix my hair / and make my seated heart knock at my ribs.† However, once Duncan is dead, Macbeth is suddenly able to kill more people more easily. So, what originally seemed very evil became normal for Macbeth. The Evil theme continues in act 5, scene 5. For example in lines 3-5, Macbeth says â€Å"here let them lie till famine and the ague eat them up† Macbeth said this without second thoughts showing that he does not feel very disturbed about people being killed or dieing horribly. Also, the evil in this scene is based more on Violence and Tyranny. For example, in lines 37-39, Macbeth says â€Å"if though speak’st false / upon the next tree shall hang though alive / Till famine cling thee†. This is clearly more gruesome and evil than killing Duncan with a dagger but it is given less importance because killing, by this point, has become more accepted in the play. Another theme in act 5, scene 5 is Appearance Vs Reality. For example, it appears that Birnam Woods are advancing and Macbeth doesn’t understand this however, it turns out to an army of soldiers carrying logs. We can tell that no body really understood why the woods were advancing because in lines 32-33 , a messenger says, â€Å"and anon, methought / the wood began to move†. Also, it appears, when Macbeth is talking about the Queen dieing, that he doesn’t care and he seems completely numb to any pain. However, I think Macbeth is just putting on a false appearance at this point to pretend he is not upset and he’s strong but in fact, I think the reality is that he is very upset but hiding it. Also, going by the riddles, it appears Macbeth is not going to die. He was promised by the second apparition in act 4, scene 1 (line 82-83) that â€Å"none of woman born / shall harm Macbeth.† Both Macbeth and the audience think that everybody is ‘of woman born’ and therefore Macbeth will not die. However, the reality, as is revealed in the very last scene in lines 15-16 in which Macduff explains that he, â€Å"was from his mother’s womb / Untimely ripped.† Meaning that he was born by caesarean section and is therefore going to kill Macbeth. Throughout the whole play, the staging is important to pass messages on to the audience. In Act 1, Scene 3, the witches enter with thunder. This emphasizes the fact that they are weird and mysterious. Also, thunder is usually thought of as a negative thing so Shakespeare, by making the witches related to thunder, give the audience a bad impression of them. It’s as though the thunder symbolises the witches’ wickedness. Also in line 33, the witches dance together â€Å"hand in hand† and they call themselves â€Å"The weird witches† showing that they are different to normal people. The audience sees the witches as outsiders and obviously would find it hard to relate to them. Another weird and mysterious part is when the witches vanish after line 78. The withes actions show the audience that they are different and this, consequently, gives the audience doubts about whether they can be trusted as, as humans, we naturally find it difficult to trust people/things we don’t know. Contrary to the witches, Ross and Angus are completely normal people, and in fact, they enter normally, with no special staging effects. Macbeth is given speaches a couple of times during Act 1, Scene 3. At first, he speaks aside in line 117-119 when he marvels at being Thane of Cawdor and Thane of Glamis and he knows that being king is still to come. He also speaks aside in lines 130, 133, 147 and 152. All of these aside speeches make the play more unrealistic. Shakespeare did this because with the play being unrealistic, it can represent the characters emotions more effectively so they play is more evocative. It also means that the audience solely concentrate on the characters and their emotions. This emphasizes them so this play is written about the emotions and the plot is just a way of portraying them. In act 5, scene 5 the Queen dies offstage. This draws the audience’s feelings towards Macbeth’s emotions and feelings as opposed to the actual death itself. This is important because death has become relatively insignificant by this point in the play because so many people have died. Therefore, drawing attention to the death would not be very effective. However, the audience is very interested in how Macbeth has changed throughout the play so his soliloquies and attention to him are very important in this part of the play. In the 17th century, Shakespeare’s plays were more enjoyed by the public because at the time, they also had a social significance. Historians have also been able to learn about life during the 17th century through Shakespeare’s play as they are closely related to society at that time. For example, in the 1600s there was a big concern about witches. People were extremely scared of them and there were rewards for catching them and horrible punishments for being a witch. This contrasts the play as the witches actually told the truth. The audience is as surprised as Macbeth is when he finds out that he was the Thane of Cawdor. In line 108, Macbeth says, â€Å"what, can the devil speak true?† to show his surprise. On the other, it was nasty of the witches to interfere and they were the main cause of all the problems so they proved to be as bad as society thought they were. The chestnut story in Act 1, Scene 3 shows the audience just how evil the witches are. This makes the audience feel happy because they have just been proved right about their thoughts about witches. Moreover, during Shakespeare’s time, loyalty to the king was one of the most important things. Therefore, Macbeth’s thoughts (line 33) were extremely bad. It would have shocked the audience. This is also one of the main reasons that Duncan’s death is offstage. It would have offended the King if he were shown dieing on stage. In Act 5, Scene 5, it is especially surprising that Macbeth tells the messenger that he is allowed to hang him alive from a tree and let him die of hunger because during the 17th century, social status was very important and the King’s status would have been considered to be much greater than a messenger’s. The fact that Macbeth told the messenger that he could treat him the same, means that Macbeth is bringing his status right down much lower than a King would normally be; to the level of the messenger. In society at that time, this would be extremely different to what everyone was used to so this event would have a huge impact on the audience. In my opinion, the unreality of the play is the main reason that Shakespeare managed to appeal to his audience both in the 17th century and in the modern era. The plot obviously had more social significance in the 17th century and was therefore probably more effective then but the plot isn’t the most important part whereas the emotions our. As our emotions haven’t changed, the play can still be enjoyed now and the modern audience can still understand, and be affected by the evocative speeches and scenes. The level of sugar in your blood sample is compared against a reference range and if it is greater than 126 mg/dl on more than one occasion, it is diagnostic of diabetes (Encyclop?dia Britannica, 2011), which is an impairment in the body’s capacity to effectively utilize and store sugars. Another confirmatory test for diabetes is the glucose tolerance test, whereby you will be made to give two blood samples. To prepare for the test you have to eat a normal balanced diet for upto three days preceding the tests. Then, like for the fasting blood sugar test, you have to fast overnight, for duration of about 8 hours and the first blood sample is collected. After that you will be made to drink a liquid containing 75 grams of glucose and a second blood sample is taken 2 hours later (Encyclop?dia Britannica, 2011). The blood sugar values obtained are compared against normal standards and if the value of the blood sugar levels obtained 2 hours after the glucose drink exceeds 200 mg/dl, it is diagnostic of diabetes (Becker, 2001). Article Critique Essay The thought that peer exclusion is correlated with children’s classroom achievements and adjustment has been hypothesized since the 1930’s. Much research and empirical evidence for such hypotheses have since been collected, and seem to agree with the premise of the correlation. Peer acceptance is the main measurement of this study. In contrast with other types of peer relationships, peer group acceptance, or rejection, is strongly connected with academic readiness and achievement. This article focuses on peer sentiments and its effect on children’s adjustment. It differs from past studies in that its approach is to measure non-observable feelings about classmates, rather than only the observable interactions. The article begins by outlining past research, and developing a premise for the study from those previous studies. The main study that this research builds upon is that of a 2001 study by Eric S. Buhs and Gary W. Ladd, who also conduct this study along with Sarah L. Herald. The premise of the study, based on the 2001 study, is that once classmates express negative feelings and actions upon a peer, those feelings and actions act as a visible marker for further rejection by the larger peer group, and the rejected child as well; as a result, the rejected peers are flagged by their peers, and are left out of classroom interactions, and as a consequence, the rejected child’s learning is impacted ultimately leading to lower levels of achievement (Buhs, Ladd, and Herald, 2006, p. 2). The prior 2001 study found that â€Å"early peer rejection was negatively related to later achievement and that this association was partially mediated through peer maltreatment and declining classroom participation, respectively† (Buhs et al. , 2006, p. 2). The authors developed a hypothesis that built upon their previous study. Their hypothesis was stated as, â€Å"it was hypothesized that prolonged peer maltreatment increases the probability that children will disengage from classrooms (or the school context) and that increasing disengagement impairs children’s achievement. Thus, it was predicted that longer rather than shorter histories of peer maltreatment, after controlling for contemporary exclusion or abuse, would mediate the link between early peer rejection and later classroom disengagement† (Buhs et al. , 2006, p. 3). The authors further state that their purpose for conducting this study was to bridge the gap between the limitations of the previous study (it was only a one year study that attempted to predict students future outcomes) by conducting a more comprehensive longitudinal study over a six year period (kindergarten through fifth grade). Methodology The research study constructed six variables to measure the children with. They include, peer group acceptance/rejection, peer exclusion, peer abuse, classroom participation, school avoidance, and achievement. Peer group acceptance/rejection was conceptualized to mean â€Å"the extent to which individuals were liked/ disliked by classroom peers,† and operationalized by sociometric ratings that were collected from peers during kindergarten. One problem with this operationalization is the ability to comprehensively scale the true feelings of one peer toward another, especially during younger years. Scales, questionnaires, and observations might be too incomplete to capture the true meaning behind the dynamics of peer to peer interactions. Another issue is of how to evaluate separate peer groups. Many times classrooms encompass only a selection of developed peer groupings throughout the grade, and might be unfairly balanced toward one group. An example of groupings would be defined by the terms, â€Å"popular,† â€Å"punk,† or â€Å"nerds. † The research might be biased toward one group, if only because they were over represented in a class room. The variable Peer Exclusion was conceptualized as â€Å"the extent to which children were the target of peers’ nonaggressive rejecting behaviors, including behaviors such as ignoring, avoiding, or refusing to associate with them in the classroom context† (Buhs et al. , 2006, p. 3). The Variable Peer Abuse—the second form of peer mistreatment—was conceptualized to mean â€Å"the extent to which children were recipients of classmate’s aggressive and harassing behaviors† (Buhs et al. , 2006, p. 3). These two variables contained indicators to distinguish between chronic peer abuse, and situational peer abuse. Again, the issue that arises is the effectiveness of these measures. The interactions between childhood peers are complex, and can change daily. The variables Classroom Participation, and School Avoidance were used to measure disengagement from the classroom environment. A large issue with this is how to distinguish individuals who might be avoiding class as an outcome of separate circumstances. If poor participation and avoidance was only observed from the angle of peer interactions, then this view is biased toward the study. The study is seeking a correlation, and if outside factors aren’t controlled for, then they will biasly effect the results of their study. A child’s family life, neighborhood, economic status, innate ability, among other factors, could influence all of the variables that this study examines. The last variable, Achievement, was defined as â€Å"the accuracy with which children could solve progressively more advanced reading, mathematics, and spelling problems on an individualized achievement test† (Buhs et al. , 2006, p. 4). The issue that comes to mind with this variable is the way it uses tests to gauge â€Å"achievement†. Some students fare better on tests than others, while some students take time to develop adequate test taking skills. Another problem is how to control for separate curriculums in different classrooms, and the quality of what is being taught. The sample contained nearly equal proportions of families from urban, suburban, or rural midwestern communities, and the sample’s ethnic composition was 17. 4% African American, 77. 1% Caucasian, 1. 6% Hispanic, and 3. 9% â€Å"other. † Family incomes were distributed as follows: 10. 9% of the sample reported total household incomes from $0 to $10,000, 10. 9% reported incomes from $10,000 to $20,000, 12. 6% reported incomes from $20,000 to $30,000, 12. 6% from $30,000 to $40,000, 12. 9% from $40,000 to $50,000, and 40. 3% reported incomes above $50,000. It suggests that the facet of peer exclusion leading to reduced participation, and ultimately delayed achievements needs further study. It goes on to say that with further study, and thus more knowledge, an empirically based intervention program can be developed. Conclusion It can be argued that to have a complete understanding of the ever evolving and complex world of the social interactions in a school environment is close to impossible. The authors came into their study with a set premise, and expectations of the outcomes, and have seemed to found what they were searching for. The question becomes, how valid are the author’s findings, and can they be applied in a general manner across learning environments. I believe studies that look at complex interactions between children over several years, such as this study, might have too many outside interactionary forces that could effect the data and results. Charge of Assault Occasioning Actual Bodily Harm (ABH) This case requires us to consider whether Harry should be charged with assault occasioning actual bodily harm (ABH) in view of the guidance contained within the Code for Crown Prosecutors.  Ã‚   The Code lays down the principles which the Crown Prosecution Service (CPS) apply when deciding whether to prosecute and any decision is taken in accordance with the Full Code Test (FCT) detailed in section 4. The first stage of the FCT is the Evidential Stage.   The CPS must be satisfied that there is sufficient evidence to provide a realistic prospect of conviction and will consider the admissibility and reliability of the evidence.   Here consideration is given to whether the evidence has been obtained in breach of the Police and Criminal Evidence Act (PACE) 1984, whether it may be excluded under sections 76 and/or 78 and whether it is admissible under Part 11 of Criminal Justice Act 2003.   There is nothing to suggest the evidence is inadmissible under these provisions. Next the reliability, credibility and weight of the evidence must be considered.   Harrys evidence does not give rise to any significant concerns in relation to reliability and/or credibility. He has no previous convictions, is generally well liked and has been provided a good reference by his tutor. Furthermore, the nightclub is described as crowded and while it is unclear whether this description relates to the nightclub in general or at the time of the incident, it lends credibility to Harrys assertion Rob was accidently jostled. Robs evidence is supported by three witness statements which suggests his evidence is also reliable and credible.   However, it would be prudent to consider the relationships between Harry, Chloe and Rob and the role, if any, these may have played in his reporting of the incident. In terms of Chloes evidence, it is not clear how far away from the incident she was or how she came to have an unobstructed view while another witness had his view obscured by other nightclub users. Additionally, while her identification evidence is given increased weight because Harry and Rob are known to her, it is possible her relationship with both men provides a motive for misrepresenting the incident, raising doubts as to the reliability of her evidence. Anitas identification evidence is problematic as her eyesight is poor and she was not wearing her glasses on the evening when the incident took place; raising serious concern about the reliability of her identification evidence. However, these concerns may be mitigated depending on how close she was to the incident, whether she knew Harry and Rob and if she was wearing contact lenses. Devs statement does not give rise to any significant concerns about reliability or credibility. However, it is unclear how Dev could positively identify both men and his statement may suggest the nightclub was crowded giving credence to Harrys assertion that Rob was accidently jostled. Considering the evidence collectively, the Evidential Stage does not appear to be met as it gives rise to reasonable doubt which lessens the prospect of conviction.   Harrys is likely to be considered a reliable witness and his explanation of the incident is plausible.   The witness statements are not sufficiently robust and while witnesses claim to have seen Harry push Rob they have not provide a clear link between Harry pushing Rob and Rob falling and injuring his hand.   Furthermore, it is not clear from the evidence whether the incident and/or witnesses perceptions were affected by their relationship to one another, lighting and/or the consumption of alcohol. The CPS can only move onto the Public Interest Stage of the FCT if the Evidential Stage is satisfied.   Despite the Evidential Stage not having been satisfied the Public Interest Stage will be applied and the importance of each factor contained within section 4.12 of the Code will be considered. ABH is a serious criminal offence. From the evidence, it appears the assault was neither premeditated nor sustained.   No weapon was used and there is no evidence to suggest the suspect intended to cause injury.  Ã‚   Furthermore, Harry has no prior convictions and is of previous good character; therefore, further offending is unlikely.  Ã‚   While the offence is considered serious these factors mitigate his culpability and weigh against prosecution. It does not appear that a position of trust or authority exists between Harry and Rob.   Neither does it appear the attack was discriminatory in nature.   However, it is not clear whether Rob is vulnerable and/or a public servant and does not provide an insight into the impact the assault and/or injuries had on him. In terms of harm caused, the definition of harm is quite wide but in the context of the offence can include injuries which are not especially serious such as minor cuts and scratches. Therefore, Rob suffered injuries which are serious in the context of the offence.   While the harm caused weighs in favour of prosecution it is difficult to consider whether this is appropriate under section s4.12(c) because the circumstance of Rob are unknown. Harry is a university student; therefore, it is reasonable to conclude he is over the age of eighteen.   His age is unlikely to be weighed against prosecution under section s4.12(d). In the absence of a Community Impact Statement it is difficult to assess the effect on the community under s4.12(e).  Ã‚   The assault was not violent or sustained and the suspect is unlikely to re-offend therefore the long-term effect can be assessed as minimal and prosecution may be perceived by the community as excessive.  Ã‚   Conversely, a decision not to prosecute may undermine the confidence of the community and victim in the criminal justice system. The maximum sentence for ABH is five years although in this case it is unlikely Harry will receive a prison sentence and a nominal penalty is expected to be imposed.   Furthermore, conviction may have serious implications for Harry depending on his area of study. Therefore, prosecution may be considered excessive under s4.12(f) given the cost of proceeding to court, the nominal penalty likely to be imposed, and the disproportionate long term effect on Harry. Had the case passed the Evidential Stage and proceeded to the Public Interest Stage more information should be sought on the circumstances of Rob and impact the offending had on the community.   On the face of it however, prosecution does not appear to be in the publics best interest. Applying the Code to the facts of this case the Evidential Stage is not sufficiently satisfied and Harry should not be charged with ABH. In his articles Stop and Search and Police Legitimacy: Part 1 and Stop and Search and Police Legitimacy: Part 2 Neil Parpworth makes a compelling argument for the inclusion of elements of the voluntary Best Use of Stop and Search (BUSS) scheme into statute.   Parpworth considers that while the BUSS scheme promised greater transparency, community involvement and improved stop and search outcomes, delivered by intelligence led approaches and increased monitoring, the report PEEL: Police legitimacy 2015 published by Her Majestys Inspectorate of Constabulary (HMIC) reveals that forces around the country are failing to comply with the scheme.   Parpworth reasons that membership of the voluntary scheme has not driven the desired change and the lack of compliance highlights the need for primary legislation. While intelligence led stop and search is an important police tool, Parpworth argues that the PEEL report reveals a concerning lack of commitment from Chief Constables in terms of ensuring the BUSS scheme is implemented effectively and search powers used legitimately.   Chief Constables play a pivotal role in terms of the internal scrutiny of stop and search yet their leadership in this area was found to be inconsistent.   While some forces had made efforts to ensure the scheme was communicated effectively and its importance recognised, others had made little attempt to communicate the scheme and promote its value.   Parpworth asserts this reluctance to advocate and communicate the importance of the scheme ultimately devalues it, reducing its prospects of success.   This he claims is demonstrated by the perception among officers that the stop and search function operates effectively without the need for additional canons and greater scrutiny. Under section 3 of the PACE 1984 officers are required to record each time they use their stop and search powers; this record should include grounds for the stop and search and show that those grounds were reasonable.   This provision, as Parpworth explains, is reinforced by the BUSS scheme which requires forces record outcomes and publish data about the connection between each search and outcome.   Parpworth argues that while these provisions aim to establish how frequently reasonable grounds were proven to be accurate, PEEL highlights that reasonable suspicion is frequently absent in many instances.   He suggests this indicates the concept of reasonable suspicion is interpreted widely by police officers in practice and that there are marked differences in interpretation between forces.   Moreover, Parpworth expresses concern over searches which were made on the basis that the police officer smelled cannabis. Parpworth suggests that while this is sufficient grounds to justif y a search it is subjective and may provide a convenient way of meeting the statutory requirement for reasonable suspicion, possibly lending itself to an abuse of the stop and search power.  Ã‚   Parpworth also expresses concern that in cases where reasonable suspicion was found to be absent supervisors had endorsed the records of their subordinates.   He suggests this indicates either a lack of understanding at senior level as to what constitutes reasonable suspicion or a failure to exercise due diligence.   Despite the BUSS requirement that the link between stop and outcome be recorded Parpworth interprets the lack of reasonable suspicion as evidence police forces are not monitoring the use of their powers effectively. Equally, while the BUSS scheme aimed to improve the stop to arrest ratio, Parpworth explains that the rates remain relatively low.   Despite HMIC holding the view arrest rates are a misleading measure of success Parpworth explains HMIC do acknowledge the low stop to arrest ratio suggests the power is being used ineffectively.
